AUGUSTINE ANYANYA ENEFIOK UDOH, ESQ. (FRM. LEGAL ADVISER,UYO-BAR) FELICITATES WITH EASTERN BAR FORUM(EBF) ON THE OCCASION OF ITS QUARTERLY GENERAL MEETING SLATED TO HOLD IN THE BEAUTIFUL CITY OF UYO FROM 24TH - 25TH MARCH, 2023. Chinua Achebe once alluded that when we gather together at moonlight to have folklore, it is not because we cannot all sight the moon from our respective homes, but it is for the spirit of kinship and brotherhood. Hence, it is not surprising that lawyers under the umbrella of EBF converge quarterly to break words and chart a new cause for EBF, the legal profession and for the greater good of the society.  Assuredly, I have no doubt that at the end of the meeting, robust and impactful decisions will be reached and agreed upon for the upliftment of legal practice and the fundamental duty on lawyers to continually play a critical role in deepening our constitutional democracy. Consequently, I commend the leadership of EBF for this massive and usual contribution to...

Do well to enjoy our awesome delicacies, to wit: Afa...

SENATE PRESIDENCY: "Gov. Umahi, Sen. Orji Kalu, et Al, do not have the moral right to deprive Akwa Ibom State Senate Presidency for the first time since independence" Meti M. Ukpeh, Esq., Uyo-based Human Rights Lawyer fumes It is no longer news that the race for senate presidency has begun and political stalwarts like Ndume, Kalu, Umahi, Akpabio, among others, are strong contenders to be the Senate President of the hallowed Red Chambers. In his words to our correspondents, the Uyo-based Human Rights lawyer said thus: "...since the birth of Nigeria and in fact democracy in this country, the good people of Akwa Ibom have been sidelined in the Headship affairs of the hallowed Chambers. Akpabio is best fit for that office. His records are there. He had transformed every sector of the his state and NDDC when he was there and can comfortably replicate same at the Red Chamber other than being a Rubber Stamp Senator for the Executive. The wait is too long--over 60years after i...

AKWA IBOM NORTH-WEST SENATE RACE: "He who comes to equity must come with clean hands. We will not vote a bench warmer to satisfy a few" Meti M. Ukpeh, Esq., Uyo-based Human Rights Lawyer fumes _If you claim Ibiono/Itu extraction of UYO SEN. DIST. should not feel "entitled" to produce the next governor of Akwa Ibom State,  what moral justification do you claim IKOT EKPENE SEN. DIST cannot produce its senator from any of its constituencies?_ _He who comes to equity must come with clean hands_ _What is good for the goose, is also good for the gander_ _The interest of the Sen. Dist. is bigger than being a BENCH WARMER_ _God will Akpabio is the best choice to serve the interest of the Sen. Dist., Akwa Ibom State and Nigeria_ _Akpabio will be a strong voice for the state. NIGERIA POLICE FORCE OR POLICE SERVICE COMMISSION OR BOTH? : The Proper Party to Join and Hold Vicariously Liable in Fundamental Rights Suits   By ~ Meti M. Ukpeh, Esq.          [Ama-Mme Anana-Owo]  INTRODUCTION : I will not bore readers with what constitutes fundamental rights suits, as these are elementary knowledge to lawyers. Most times, these fundamental rights matters have the Nigeria Police Force, Police Service Commission or both joined by an aggrieved applicant. Note: Police, in the usual context, include other security agencies. See: S.492 of Interpretative Section of Administration of Criminal Justice Law of Akwa Ibom State, 2022. However, this work will use the word "Police" in the restrictive and literal sense of Nigeria Police Force.  Before now, it has been a rigid practice that since the Police Service Commission (hereinafter referred to as "Commission") is the employer of police officers in Nigeria, the commission ought to be sued, joined and/or vic...

Accordingly, law as a modulator of conducts in the society has had various applications in nations and Nigeria is one of those nations as evident in its laws such that infractions to these laws have a resultant consequence. One of the major areas of law that has the highest rate of infringements is the area of fundamental rights that have been enshrined in the constitution of Nigeria (chapter IV). These rights are inherent and inures on every being such that infringements on them have local or domestic and international sanctions as evident in so many international treaties, conventions, protocols of international and regional bodies of comity of nat...
