Meti M. Ukpeh, Esq. & E. D. Eboro,  Esq., Welcome Young Lawyers to the Garden City of Port Harcourt for the 2021 NBA-AGC Apparently,  the 61St AGC  is star-studded and well cooked with sociocultural,  political and intellectual ingredients;  hence, we certainly convinced  to the marrows that this  conference will certainly impact young lawyers especially and the future of the Bar.  Consequently,  we welcome all and sundry heartily. It is our belief that this AGC  would chart the right cause for the nation,  the security woes,  the political mishap, and ultimately remodeling the NBA to the betterment of the Bar.  Once again,  you are heartily welcome to the 61St AGC in Rivers State.

MARITIME MORTGAGE : THE GONG OF THE LAW

Image
INTRODUCTION It is true that business minds who invest in the business of shipping usually seek the assistance of financial institutions for finance to start up. Sometimes, these institutions advance loan to these business minds for the purchase of ships, and this is usually by way of mortgage on the ship. It is the ships themselves which serve as security for any loan until the repayment is done. The financial institution which advances the loan is known as the “mortgagee” the owner of the ship who obtain the loan is the “mortgagor”, and the ship remains the mortgaged asset. The loan agreement contain covenants regulating the conduct of the borrower, the mortgagor gives the mortgagee a preferential security interest in the ship, insurance to protect the interest of the mortgage on the ship, assignment of the insurance proceeds of the ship in the event of loss, and the assignment the earnings of the ship.  I.  WHAT IS SHIP MORTGAGE ? Put simply, A legal mortgage is...

THE LAW WINS,  BUT THE EXECUTIVE GRIEFS: UNDERSTANDING THE LANDMARK JUDGEMENT IN JAMES V. GOVERNOR OF EDO STATE & ORS, (2021) LPELR-54203 (CA)                        BY  METI MONDAY UKPEH ESQ.  (AMA-MME ANANA-OWO)   UYO NBA BRANCH 08164013230 Metiukpeh8899@gmail.com ABSTRACT Verily, Denis de Braxton, a famous legal philosophy, had said thus: the world is governed by man, divine or law. Accordingly, law as a modulator of conducts in the society has had various applications in nations and Nigeria is one of those nations as evident in its laws such that infractions to these laws have a resultant consequence. One of the major areas of law that has the highest rate of infringements is the area of fundamental rights that have been enshrined in the constitution of Nigeria (chapter IV). These rights are inherent and inures on every being such that infringements on them have local or domes...

VAT LAW: WHY AKWA IBOM STATE SHOULD JOIN RIVERS AND LAGOS STATE.

Image
VAT LAW: WHY AKWA IBOM STATE GOVERNMENT SHOULD JOIN RIVERS & LAGOS STATES Obviously, it is no longer news that from the socio-political angle, the clamour for fiscal federalism, true federalism, is rife. It is widely viewed as an instrument of sustainable peace and unity as well as geographically spread rapid economic development in Nigeria. It is high time the culture of states leaning on revenue distribution from the centre ended. The power of VAT collection should be restored to states as a step in the right direction. Let the states be enabled to look inwards and activate their potentials in commerce and industry The recent decision of the Federal High Court in Attorney General of Rivers State Vs Federal Inland Revenue Service, has received more commendations from the Nigerian populace than not. Consequently, it has tickled the pens and awoken the dogma of well-meaning Nigerians. Recall that in October 2019, the Federal High Court, Lagos Division, in the Registered ...

NBA-AGC FEE PILING UP WOES: WHY FEE SHOULD BE REVIEWED TO #5,000 FOR YOUNG LAWYERS.

Verily,  it will be sympathetic for us to still tie ourselves to the cleaves of Cliché,  that it is "TOO EARLY TO RAISE CONCERNS" about the leadership styles of our "leaders", NBA President inclusive.  In a nation where leaders sleep in taverns of comfort, with their protruded bellies stick to the Western world and their anuses farting to the already fainted masses,  our NBA should stand out!  In our country  where the executive is self-bedeviled with barons and baronesses of incompetence,  sleeping over the cries of security and people-oriented programmes,  our NBA should stand out!  In a same nation where our Judiciary is wrapped in a life-draining executive imposition and dependence,  hence churning out godforsaken lapses in Orders,  Rulings and decisions; yet again, our NBA should stand out!  But comfort is not on my side upon a careful and objective perusal of the July and August scorecard of our NBA President,...

THE CONSTITUTION OF EASTERN BAR FORUM, 2015 AS MENDED: The Blur in Art. 4.,  A Case For An Expedient Need For A Resolution Than Conventions and Practices By ~ Meti Monday Ukpeh Esq.        [Ama-Mme Anana-Owo] In sooth, it is a sigh of relief and a stream of legal fragrance brought by the adoption of the said constitution by the General Assembly of the Eastern Bar Forum on the 18th day of July, 2020. There is no doubt or hesitation that a regional legal framework as the EBF would not toe the path of collective doggedness in reconciling the essence of legal practice for its members while also projecting its aims and objectives as evident in Art. 3 (2) of the EBF Constitittion ( hereinafter referred to as “the constitution”.) However, a cursory look at Art.4 of the said constitution creates room for blurry and speculative imputations prone to conjectures against certainty. For the avoidance of doubts, Para. E  of a Art. 4(1) creates the YOUNG LAWYERS FORUM as one of the organs of EBF and ...
